Creating Documents: Writing, Speaking, Saving

  • Also part of the Legal Preparedness Reference Library (boxed set).

Stresses to all employees the importance of “defensive thinking” when it comes to written and verbal communication—in order to avoid creating a record of careless and provocative words that could be disastrous if misinterpreted.

    Training Topics:

  • Dangers of careless writing, speaking: inaccurate, unclear, or otherwise ambiguous or provocative language
  • Need to state things precisely and accurately, leaving no room for misinterpretation in court, in the media, or in the minds of outsiders
  • Discovery: "dragnet" search to unearth "problem" documents
  • Email: casual attitudes toward writing and addressing
  • Document creation: discarded drafts through final versions
  • Paper and electronic records
  • Document retention: hazards of excessive saving
  • Document destruction: gaps in the files

    Overview:
The high point of a motivational meeting is manager Bill Cram in a raucous parody of a famous movie adventure hero. As the ultra-militant "Crambo," Cram issues "marching orders" to the "troops" in the audience. It's only intended to be funny, but his ambiguous words and over-the-top performance suggest unfair competitive practices and lead to consequences Cram never dreamed of. In another vignette, a carelessly worded and widely disseminated email message results in a public relations disaster. Other stories illustrate how ill-chosen language in memos, drafts, email, hand-written notes, telephone messages -- as well as appointment books, diaries, ledgers, and the like -- can end up as evidence against an organization. The famous email message traffic of White House special assistant Oliver North -- supposedly deleted, but later recovered and published -- is used to illustrate how vulnerable email is.
